TERMS AND CONDITIONS

1. Scope and Contracting Parties
(1) These Terms and Conditions govern all contracts, orders, and transactions between https://swanprint.art, operated by Nicola Hackl-Haslinger (hereinafter referred to as "we", "us", or "the provider") and customers (hereinafter referred to as "you" or "the customer").
(2) Our online shop specializes in selling art prints and limited editions. By placing an order, you confirm that you are legally capable of entering into a binding contract.
2. Product Information
(1) Our shop offers fine art prints, including limited editions and open editions. Each product description includes details about print size, paper quality, and edition type (if applicable).
(2) Limited edition prints are produced in a fixed quantity. Once an edition is sold out, no additional copies will be made. Each limited edition print comes with a certificate of authenticity signed by the artist.
(3) Due to the nature of printing and screen display differences, slight variations in color between the digital images and the final print may occur.
3. Offer and Contract Formation
(1) The presentation of products in our online shop does not constitute a legally binding offer but an invitation to order.
(2) By clicking the "Order" button, you place a legally binding order for the selected prints. A contract is only concluded when we confirm your order via email.
(3) We reserve the right to reject orders in certain cases, such as suspected fraud, payment issues, or high shipping risk.
4. Prices and Payment
(1) All prices are displayed in EURO, inclusive of VAT where applicable.
(2) Shipping costs are not included in the product price and will be displayed separately at checkout.
(3) We accept the following payment methods:
- Credit Card (Visa, MasterCard, AMEX)
- Bank Transfer (SEPA for European customers only)
- Other payment methods as indicated at checkout
(4) The purchase price is due immediately upon order confirmation. We reserve the right to cancel unpaid orders.
5. Shipping and Delivery
(1) We offer worldwide shipping, mainly to European and American countries.
(2) Shipping times vary depending on the destination:
- Austria & Germany: 3–5 business days
- Rest of Europe: 5–10 business days
- America & other international destinations: 10–20 business days
(3) Each print is carefully packaged to ensure safe delivery. If your package arrives damaged, please contact us within 7 days with photos of the damage.
(4) Shipping delays may occur due to customs clearance, weather conditions, or other unforeseen circumstances. We are not responsible for delays caused by postal or courier services.
(5) If an item is returned due to an incorrect shipping address provided by the customer, additional shipping costs will apply.
(6) The risk of loss or damage passes to the customer upon delivery to the carrier.
6. Right of Withdrawal (EU Customers Only)
(1) If you are an EU-based consumer, you have the right to withdraw from your purchase within 14 days without giving any reason.
(2) The withdrawal period starts from the day you receive the goods.
(3) To exercise your right of withdrawal, you must inform us via email at photography@nhh.art or by mail at Leitnergasse 4, 4040 Gramastetten, Austria.
(4) You must return the goods in original, undamaged condition within 14 days after notifying us. The return shipping costs must be covered by you.
(5) The right of withdrawal does not apply to:
- Limited edition prints, as these are produced in fixed quantities.
- Custom-made or personalized prints (e.g., prints with artist's personal dedication).
- Unsealed or used prints that cannot be resold.
(6) Once we receive and inspect the returned goods, we will refund the purchase price within 14 days via the original payment method.
7. Warranty and Liability
(1) Customers within the EU are entitled to a 2-year warranty on defective goods, in accordance with Austrian consumer law.
(2) If a print arrives damaged or defective, please contact us within 7 days with photos of the damage. We will either replace the item or issue a refund.
(3) Our liability is limited to cases of intent and gross negligence. We are not responsible for indirect damages, lost profits, or technical failures beyond our control.
8. Customs and Import Duties
(1) For shipments outside the European Union, customs duties, import taxes, and other fees may apply. These costs are not included in the product price or shipping fee.
(2) The customer is responsible for all applicable import regulations and charges. Please check your country’s customs policies before ordering.
9. Intellectual Property and Copyright
(1) All prints sold in our shop remain the intellectual property of the artist. Purchasing a print does not grant you the right to reproduce, modify, or distribute the artwork in any form.
(2) Unauthorized reproduction, resale, or commercial use of the prints is strictly prohibited.
(3) If you wish to use an artwork for editorial, promotional, or commercial purposes, please contact us for licensing inquiries.
10. Governing Law and Dispute Resolution
(1) These Terms and Conditions are governed by the laws of Austria, excluding conflict-of-law provisions.
(2) In case of disputes, the competent court is Bezirksgericht Urfahr Umgebung, Linz, Austria, unless consumer protection laws dictate otherwise.
(3) For consumers within the EU, online dispute resolution is available via the EU Online Dispute Resolution Platform.
11. Changes to Terms and Conditions
We reserve the right to update these Terms and Conditions at any time. The latest version is available at https://swanprints.art/terms.
